Proposed Amendment to our Bylaws
April 23, 2025
Our board of directors is hereby announcing a proposed amendment to our Bylaws. This amendment would mandate an alternative dispute resolution ("ADR") process - Binding Arbitration - as our mechanism for resolving disputes with shareholders. This would preempt law suits potentially resulting in court trials and the lengthy and costly legal processes they typically present.Â
The motivating intention of this amendment is to save substantial amounts of both time and money on resolving any future disputes. Legal fees associated with lawsuits are expensive. Because we wish to delay raising ratest for all shareholders as long as possible, it is important for Forest Park Mutual Water Company to ratify an amendment to our Bylaws that we expect will expedite resolution of any future disputes and significantly reduce legal costs.
We intend to vote to adopt this Amendment (or a close variation) in our June board meeting. Please review this draft (link below) and send any requests for changes to: Secretary@ForestParkMWC.org. The deadline for submitting requests for changes to this proposed amendment is May 31, 2025.
